Dog Rules If I Buy A Condo
So if you are anything like me, you love your pets. In fact, my pets are basically the shot callers 😊 in my family. If you are thinking about buying a home in an HOA governed community or a condo that falls under HOA CCR’s and Rules, make sure to check those guidelines. Many HOA’s will have restrictions as to certain types of pets you can own, limitations on the size of your pets, breed restrictions, weight restrictions, or other types of restrictions.
It is much easier to ask these questions up front then to buy a home or condo under strict rules and realize you have a pet problem.

The way a San Diego home purchase works is HOA rules will be delivered to you during your due diligence period (or escrow). Here is the key: Be proactive and know what the pet restrictions are way before you get to this point. It will save you valuable time and money.

Common rules I have seen that you might encounter as well are a maximum of 2 pets, regardless of type. Weight restrictions are common. Even breed restrictions can be in play (usually that is due to insurance reasons an HOA might be contending with).
HOA pet restrictions can lead to a couple common scenarios:
- The HOA (of which the all owners are automatically a part of) can enact updated or new pet restrictions. If this happens, any owner already owning a property under that HOA’s govern is grandfathered in. No problem.
- A person buys a property that falls under the HOA’s govern and the new owner is in violation due to an existing pet. In this case, the HOA can actually force you thru court injunction to remove the pet from the premises… In that unfortunate situation, the pet me be removed.
Even in developments where pets are restricted and not allowed, service animals are permitted by law. No questions asked!
An HOA is 100% within its rights require owners to follow condo and municipal regulations such as requiring an animal to be on a leash when outside the condo or home and requiring pet owners to pick up waste… Yes a no brainer for most of us but some people don’t care and are gross.
